Terms of Service – Inspectsy

Welcome to Inspectsy, a service operated by Inspectsy Tech Pty Ltd (ABN 58 689 047 630). These Terms of Service ("Terms") outline how you can use our platform and what to expect from us in return.By using Inspectsy, you agree to these Terms. If you don’t agree, please don’t use the platform.

1. Overview
Inspectsy provides AI-powered property inspections that reduce admin, costs, and on-site risks.

The platform guides users through step-by-step photo capture, prompts retakes where needed, and generates structured visual reports. Reports are created with AI but remain subject to human review.

2. Account & Access
To use Inspectsy you may need to create an account or receive an access link. You agree to:
- Provide accurate, truthful details.
- Keep login credentials secure.
- Notify us of any unauthorised access.

You are responsible for all activity linked to your account or access link.

3. Acceptable Use
You must not:
- Upload false, misleading, or defamatory content.
- Interfere with security or performance.
- Copy or reverse-engineer the system.
- Submit irrelevant or inappropriate media.

Breaches may result in suspension or termination of access.

4. Your Content and How We Use It
You retain ownership of any photos, videos, notes, or other content (“Content”) uploaded.

By uploading content, you grant Inspectsy a non-exclusive, royalty-free licence to use, store, modify, and display your content for:
- Operating and improving the platform
- Customer support and troubleshooting
- AI model training (in de-identified form)
- Analytics and quality control

You confirm you have the rights to share your content and that it does not infringe others’ rights or include unlawful material. Inspectsy may review or remove content that breaches these rules.

5. Use of AI, Report Accuracy & Your Responsibility
Inspectsy is designed to make inspections faster, easier, and more consistent. AI assists with capturing, organising, and summarising visual evidence.

Reports are generated from submitted photos and data. Inspectsy organises everything captured, but reports do not assess structural, pest, or building compliance issues.

We recommend property managers:
- Review each report and media before taking action.
- Follow up where images are unclear or missing.
- Apply professional judgment when sharing reports or scheduling maintenance.

Inspectsy supports your process but does not replace your responsibility.

6. Fees and Payment
 Each new account includes 2 free inspections.

A “completed inspection”
- means a report generated after the inspection workflow is finished.
After the 2 free inspections:
- Users must add valid payment details to access reports.

By providing payment details
- You authorise Inspectsy to charge $10 per completed inspection.

Payments are processed securely by Stripe.
- Inspectsy does not store card details.

Plan details:
- Accounts are automatically enrolled in the per-inspection plan.
- This is not a subscription. You only pay per completed inspection.

Pricing changes:
- Inspectsy may update pricing in the future.
- Add new plans
- Reasonable notice will be provided.
- Continued use after notice means acceptance of the new rates.

7. Tenant Submissions and Responsibilities
Where tenants or occupants are guided through an inspection, they are responsible for ensuring that submissions reflect the true condition of the property.

By continuing with an inspection, users confirm that:
- The information is truthful and not deliberately misleading.
- False or incomplete submissions may be used as evidence in tenancy-related disputes.

The reviewing agency or property manager remains responsible for assessing completeness and following up.

8. Availability and Support
Inspectsy aims to provide reliable access but does not guarantee uninterrupted service. You acknowledge that:
- Downtime or maintenance may occur.
- Features may be added or removed without notice.
- Inspectsy is not liable for losses arising from unavailability.

Support is provided on a best-effort basis.

9. Privacy
Our Privacy Policy explains how Inspectsy collects and handles personal information, including images, emails, and inspection data. By using Inspectsy, you agree to this handling of information.

10. Limitation of Liability
To the maximum extent permitted by law, Inspectsy Tech Pty Ltd and its team are not responsible for:
- Direct or indirect loss, including data loss or missed revenue
- Actions taken based on reports
- Issues arising from the availability or unavailability of Inspectsy

Inspectsy is provided “as is.” You agree to verify anything important before relying on a report.

11. Termination
We may suspend or remove access at any time, including if:
- You breach these Terms
- We discontinue or restructure access
- You are inactive for an extended period
- You request deletion of your account

When access is removed, your account will be closed, and data handled in line with our Privacy Policy.

12. Intellectual Property
All intellectual property in Inspectsy, including software, branding, AI models, and documentation, belongs to Inspectsy Tech Pty Ltd.

You may not copy, reverse-engineer, or distribute any part of the platform without written permission.

13. Changes to These Terms
We may update these Terms from time to time. If significant changes occur, we’ll update the “Last updated” date and aim to notify users by email or in-app.

14. Governing Law
These Terms are governed by the laws of Victoria, Australia. Disputes will be handled in the courts of Victoria.
